UPDATE: as of 1/12/24 we have an updated terms and conditions policy for all new reservations. This page applies to any reservations before 1/12/24.

This property has the following check-in and check-out times and policies

Check-Out: 9:00 AM

Cancellation, Refunds, and Early Termination Policy

Cancellation of your booking prior to arrival  is limited to your non-refundable reservation deposit (see below).  After arrival, no refunds are given on rent or any fees that have already been paid.  Please see the Notice to Vacate Policy below.

Non-Refundable Reservation Deposit

To make a reservation (book) and place a furnished apartment in your name so that no one else can book it away from you, a non-refundable deposit may be required at booking.  The reservation is not complete, and the apartment will remain available to others until the deposit is paid.

Move-Out/Notice to Vacate Policy

A written 15-day departure notice with move date must be received for all stays. Final month’s rent payment can not be prorated or calculated until an exact move out date is received by SOMNI  Inc.  Guests must be moved by 9am on that date or an additional day of rent will be charged. Guests are financially responsible for all rent and any other expenses that arise from their stay until the last day of the 15 days notice that they have provided.  If no vacate notice has been given, Guests will continue to accrue these expenses until proper 15 day notice is received in writing (text or email), and keys have been turned in.  Somni reserves the right to waive any Notice to Vacate Terms.

This policy supersedes any automatic emails or automatic texts sent from SOMNI stating an exact move-out date.

Holdover / Extensions

If written notice by either party is not given at least 15-days prior to the termination of the lease, then a new month-to-month agreement to stay in the apartment shall be created, subject to the same terms and conditions at the time of the booking, at the same monthly per month rate, unless otherwise agreed by the parties in writing. Such month-to-month tenancy shall be terminable on thirty (15) days written notice by either party or on longer notice if required by law.

Payment Policy

Guest acknowledges and authorizes SOMNI  to charge Guest’s credit card or bank account, for all rent, deposits, applicable taxes, and extra charges incurred as a result of booking and staying, and damaged and/or missing items to the premises while occupied by the guest.  If the cost of extra cleaning, replacement or repairs exceeds the guest’s credit card limit, the guest agrees to pay the difference to SOMNI.

  • Rent is billed and paid in advance of your stay

  • The first rent payment will be processed prior to your move-in date.

  • Rent is prorated at the beginning of your stay and at the end of your stay (including the notice to vacate period)

  • Weekly payments will be billed on Sunday or Monday

  • Monthly Payments are billed within a week (before or after) of the 20th of the month.

  • Monthly payments are calculated by taking the nightly rate multiplied the number of nights in a month (20th-20th of the next month)

Late fees will be applied in accordance with Iowa law if rent is not able to be paid on time. Any unpaid rent or charges arising out of this rental agreement will be sent to a third-party collection company.  Any fees or charges that arise out of this agreement (bank fees for non-payment, chargeback fees, late fees, etc), will be the responsibility of the Guests/guest.

Guests/Guest listed in this reservation is responsible for all rent and any charges arising out of this rental agreement until the end of the rental period including the 15 days from the notice to vacate date. If paying monthly, if your stay starts or ends creating a partial month, the daily rate will be calculated as follows:

If a monthly rate is agreed upon, to prorate, the monthly rate is divided by 30 days.

Key Pick-up and Drop-off

Key arrangements should be made with SOMNI Inc,. there is a $50 charge for each missing key, laundry card, fitness room fob, or access card on your move-out day.

Use of Property

It is agreed that the Premises shall be used only for residential purposes.  All guests in the possession, use, and Guests of the home agree to observe and comply with all restrictions, laws, and ordinances affecting the home or Guests thereof. All guests agree and represent that their use and Guests of the apartment or accommodation are considered to be of a transient nature and that the apartment or accommodation is not, nor intended to be a permanent residence.

Guest's use and Guests of the apartment or accommodation shall not create any landlord/guest relationship.  This reservation agreement is NOT a lease and is not intended to convey to the guest any real property interest in or to the apartment or accommodation.

Guests shall not sublet, nor assign, any part of the apartment or accommodation.  This includes sites such as Airbnb, Home Suites, VRBO, Home Away, etc.  Violation of this clause subjects guests to any and all applicable fines and eviction.

Damages

Guests accept and assume all responsibility for any/all damages or losses incurred, as a result of their stay.  This includes, but is not limited to guests personal property and to any property, housewares, furnishings, and other items provided by SOMNI.  The cost of cleaning (above normal wear and tear) and repairs will be charged to the guest. Guest agrees to notify SOMNI  in a timely manner in the event any damages or losses occur to the apartment or accommodation, the furnishings, the property, or the community. Guest is responsible for the actual replacement costs for any lost or damaged keys, fobs, remotes, or laundry cards provided.

Refundable Security Deposits

If a refundable security deposit is charged, it shall be returned in the same manner in which it was paid, to the same person or company that paid it,  in accordance with Iowa law, with written accounting made for any portion retained, listing the exact reasons for the retention (missing items/damages, rents, late fees, unit charges, departure fees, excess utilities, phone charges, other charges due under this agreement and interest as due), together with the balance of the security deposit within thirty (30) days after the end of the Guests (not necessarily the dates listed on this rental agreement)..

Exit Cleaning Fee

An exit cleaning fee may be charged for a stay.  Additional ‘Mid-Stay Cleans’ may be scheduled at your convenience (extra charges apply).

Smoking

We currently have no homes that allow smoking of any kind, including vaping. Smoking is not allowed in the apartment or accommodation at any time. Violators of this policy will be subject to an additional charge to cover any lost Guests time (the time the apartment or accommodation is vacant as we clean the property thoroughly to get it back to non-smoking status), as well as charges to replace furnishings, linens, equipment, painting, extra cleaning, scrubbing walls, etc.

Pet Policy

We do allow animals but no animals (including mammals, reptiles, birds, fish, rodents, and insects) are allowed, even temporarily, anywhere in the apartment or apartment community unless we’ve so authorized in writing.  If we allow an animal, please note that there may be apartment community-specific rules, deposits, rents, fees, or other charges. If bringing a service animal, documentation must be provided by prescribing physician on their official company letterhead with the phone, email, and address for verification.  No pet fees or rents will be charged for service animals. Any damage that was done by service animals, or any pets, will be charged to the guest(s) listed on the reservation.

IMPORTANT: If you wish to stay beyond the departure date on the reservation, please call to see IF an extension is possible.  During our busy months, we may have rented your apartment to another guest.

Indemnification

Occupants, nor their guests or visitors shall neither hold, nor attempt to hold, SOMNI  agents, contractors, or employees liable for any injury, damage, claims or loss to person or property occasioned by any accident, conditions, or casualty to, upon, or about the property including, but not limited to, defective wiring, the breaking or stopping of the plumbing or sewage upon the property, unless such accident, condition or casualty is directly caused by intentional or reckless acts or omission of SOMNI. Notwithstanding any duty, SOMNI may have hereunder to repair or maintain the property, in the event that the improvements upon the property are damaged by the negligent, reckless, or intentional act or omission of the guest or any licensees, invitees, or co-guests, the guest/guest shall bear the full cost of such repair or replacement. guest shall hold all SOMNI agents, and their respective successors and assigns, harmless and indemnified from all injury, loss, claims, or damage to any person or property while on the property or any other part of the property, which is occasioned by an act or omission of the guest, guest’s licensees, invitees or co-guests. SOMNI is not responsible for any damage, theft, or destruction to the guest’s personal property. All guests shall obtain renters insurance at the guest’s sole discretion and expense.

Cable / Internet /  Phone Service (if provided, please verify)

If a phone is provided, local and long-distance domestic calls are provided free of charge. Foreign long-distance or other additional fees billed to the unit's phone will be charged to your account.  Any pay-per-view movies or additional programming outside of what SOMNI provided at move-in will be charged to the person listed on this rental agreement.

Pets

All community-specific pet rules and fees must be adhered to, i.e. Poo Prints (DNA saliva swab), breed restrictions, pet size restrictions, and the number of pets allowed.  All guests are responsible for inquiring about specific pet rules per their specific community and follow all pet rules.  All guests must get permission from Somni before bringing a pet so that pet rules can be identified and followed. If bringing a service animal, documentation must be provided by prescribing physician on their official company letterhead with the phone, email, and address for verification.  No pet fees are charged for service animals. Any damage done by service animals or pets will be charged to guests. All pets must be housebroken, and cats must be declawed. Dogs must be over 6 months of age AND all pets must be potty trained.  Pets must be kept on a leash when outside of the apartment.  Guests must clean up after their pet when outside of their apartment.

General Care and Cleaning of Property

Guest/guest shall keep the rental unit in a clean condition, including, but not limited to, weekly dusting, vacuuming, wiping, and scrubbing, especially kitchen (and appliances) and bathrooms (tub, sink, flooring, and toilet).  guest agrees to wash any linens provided by SOMNI weekly or more frequently, especially sheets, pillowcases, towels, and washcloths. Alternatively, the guest may request housekeeping which will be an additional charge.  guest agrees to report any maintenance issues immediately to SOMNI  Inc.

Cancellation, Refunds, Early Termination Policy

Guests of SOMNI are financially responsible for paying rent for the complete rental term, including the full extent of the 15-day notice to vacate policy.  This includes any and all deposits required by SOMNI  listed above in the reservation agreement, and rent for the complete rental period plus any holdover time. No refunds for early departure or non-arrival, for any rent that has already been paid, or for any application fees. If rent payment has been made prior to arrival, notice must be received more than 30 days in advance of the reservation arrival date, less a $150 service charge.  No refunds for less than 30 days’ notice.  

Late Arrival

Guests are responsible for paying rent beginning with the date that they booked the apartment for.  Charges are NOT waived for late arrivals (i.e. arriving the next day or a week late).

To make a reservation and place a furnished apartment in your name, so that no one else can book it away from you, a non-refundable deposit may be required at booking.  Your reservation is not complete, and the apartment will remain available to others until the deposit is paid.

Move-Out/Notice to Vacate Policy

A written 15-day departure notice with an exact move date must be received for all stays.   Somni is unable to calculate the final prorated rent payment until an exact move-out date is provided to SOMNI. Guests must be moved by 9 am on that date or an additional day of rent will be charged.

Guests are financially responsible for all rent and any other expenses that arise from their stay until the last day of the 15 days notice that they have provided.  If no vacate notice has been given, Guests will continue to accrue these expenses until proper 15-day notice is received in writing and keys have been turned in.

This policy Notice to Vacate Policy is in effect starting July 15, 2022. For prior reservations, please see your rental terms and conditions signed at the time of booking.

Housekeeping service

Housekeeping service is available on all units and can be scheduled for your convenience with your reservation agent (additional fees apply) 

Short Term Rental Agreement | Hotel Innkeepers Law

It is expressly understood and agreed that this is a short-term rental, and is NOT a lease or other long-term residential tenancy agreement. This Agreement is only for the use of the Property for the stated Term. It creates no property rights to Guest and no rights to renewal. This Agreement is also neither a Time-Share sale or a Plan of Time-Share Development, nor a Vacation Club.  This is not a lease or residential tenancy agreement, nor does it convey any property, legal or beneficial rights or interest in real estate to you.  You are not a guest of the accommodation or apartment community.  You have not been granted exclusive possession of the accommodation.

Dispute Resolution

Any controversy or claim arising out of or relating to this Agreement, the relationship resulting in or from this Agreement or breach of any duties hereunder will be settled by Arbitration in accordance with the Arbitration Rules of the U. S. Arbitration & Mediation (“USA&M”). All hearings will be held in Sioux City, Iowa before an Arbitrator who is a licensed attorney with at least 15 years of experience. A judgment upon the award rendered by the Arbitrator shall be entered in a Court with competent jurisdiction. The Federal Arbitration Act (Title 9 U.S. Code Section 1 et. seq.) shall govern all arbitration and confirmation proceedings. As a condition precedent to the filing of an arbitration claim, the parties agree to first mediate any claims between them at USA&M. Any party refusing to mediate shall not prevent the other party or parties from pursuing their claims in arbitration. The parties will share the cost of mediation equally. Nothing herein will be construed to prevent any party’s use of injunction, and/or any other prejudgment or provisional action or remedy. Any such action or remedy will not waive the moving party’s right to compel arbitration of any dispute. The parties agree to also meet and negotiate in good faith in order to resolve any disputes which may arise between them.
